Terms of Service

1. Agreement
These Terms of Service ("Terms") form a binding agreement between you ("Customer") and Pawa Systems ("we", "us"). By creating an account, purchasing a service, or otherwise using our products, you agree to be bound by these Terms.
2. Services
We provide domain registration, hosting, messaging APIs, payments, POS, and custom-software services as described on our website. We may improve or modify features from time to time; material changes will be communicated in advance.
3. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account.
4. Acceptable use
You may not use our services to send unsolicited bulk messages, host illegal content, infringe intellectual property, attempt unauthorised access, or perform activities that compromise the security or stability of our infrastructure.
5. Fees & billing
Fees are charged in advance for subscription services and per transaction for usage-based services. All fees are non-refundable except where required by law. Late payments may result in service suspension after written notice.
6. Service levels
We target 99.9% monthly uptime for production services. Where a separate SLA is signed, the SLA prevails.
7. Intellectual property
We retain all rights in our platform, software, and documentation. You retain all rights in the content and data you submit. You grant us a limited licence to host and process that content solely to provide the services.
8. Confidentiality
Each party will protect the other's confidential information with at least the same care it uses for its own, and will not disclose it except as needed to perform the Terms.
9. Warranties & disclaimers
Services are provided "as is" to the maximum extent permitted by law. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
Neither party will be liable for indirect, incidental, or consequential damages. Our aggregate liability is limited to the fees paid by the Customer in the 12 months preceding the claim.
11. Termination
Either party may terminate for material breach not cured within 30 days of written notice. Upon termination we will assist with reasonable data export for 30 days, after which data is deleted as described in our Data Policy.
12. Governing law
These Terms are governed by the laws of the United Republic of Tanzania. Disputes will be resolved in the courts of Dar es Salaam, without prejudice to mandatory consumer protections.
